1. Acceptance of Terms

Welcome to Nourest. These Terms of Service ("Terms") govern your access to and use of the Nourest website located at www.nourest.com (the "Site") and the purchase of products and services offered by Nourest ("we", "our", or "us"), a company registered and operating in the United Arab Emirates.

By accessing or using our Site, placing an order, registering an account, or requesting a Free Home Trial, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Site or services.

We reserve the right to update these Terms at any time. Changes will be posted on this page with a revised effective date. Your continued use of the Site after any changes constitutes acceptance of the updated Terms.

2. Eligibility

To use our Site and purchase products, you must:

•       Be at least 18 years of age

•       Be legally capable of entering into a binding contract under UAE law

•       Provide accurate, current, and complete information when creating an account or placing an order

•       Reside or have a valid delivery address within the UAE (for delivery services)

By using the Site, you represent and warrant that you meet all of the above eligibility requirements.

3. Products, Pricing, and Availability

Nourest offers premium massage chairs, foot massagers, massage tables, massage beds, and related accessories. We reserve the right to modify our product range at any time without notice.

All prices displayed on the Site are in UAE Dirhams (AED) and are inclusive of applicable taxes unless otherwise stated. Prices are subject to change without prior notice. Promotional prices and discounts apply only for the period specified and cannot be combined with other offers unless explicitly stated.

We make every effort to ensure product descriptions, images, and specifications are accurate. However, we do not warrant that all product information is error-free, complete, or current. In the event of a pricing error, we reserve the right to cancel or adjust any orders placed at the incorrect price and will notify you promptly.

Product availability is subject to stock levels. If an item you have ordered becomes unavailable after your order is confirmed, we will contact you to arrange an alternative or issue a full refund.

4. Orders and Contract Formation

When you place an order on our Site, you are making an offer to purchase the selected products. A binding contract is formed only when we send you an order confirmation email or message acknowledging acceptance of your order.

We reserve the right to refuse or cancel any order at our discretion, including but not limited to cases where:

•       The product is no longer available or has been discontinued

•       There is a pricing or description error on the Site

•       We are unable to verify your payment or delivery information

•       An order appears to be fraudulent or placed in bad faith

If your order is cancelled after payment has been taken, a full refund will be issued to your original payment method within 7–14 business days.

5. Payment

We accept payment via major credit and debit cards (Visa, Mastercard) and any other payment methods displayed at checkout. All transactions are processed through a secure, encrypted payment gateway.

By providing payment information, you represent and warrant that you are authorised to use the chosen payment method and that the information provided is accurate. Nourest does not store your full card details on our servers.

Payment is taken at the time of order confirmation. In the event of a failed payment, your order will not be processed, and you will be notified to provide alternative payment details.

6. Delivery and Installation

Nourest provides free delivery and installation across the UAE for all qualifying orders. Delivery timelines are estimated and may vary based on your location, product availability, and scheduling. We will contact you to arrange a convenient delivery and installation appointment.

You are responsible for ensuring:

•       A suitable space is available and prepared for the product prior to installation

•       An authorised adult (18+) is present at the delivery address at the agreed time

•       Access to the premises is provided to our delivery and installation team

Nourest is not liable for delays in delivery caused by factors outside our reasonable control, including but not limited to extreme weather, traffic, access restrictions, or force majeure events. If a delivery appointment is missed due to circumstances on your end, a rescheduling fee may apply.

7. Free Home Trial

Nourest offers a Free Home Trial for eligible products, allowing you to experience the product in your home before committing to a purchase. The trial is subject to availability and scheduling.

By requesting a Free Home Trial, you agree to:

•       Allow our team to deliver, set up, and retrieve the trial product at the agreed times

•       Take reasonable care of the trial product during the trial period

•       Not use the trial product commercially or allow unauthorised persons to operate it

•       Notify us promptly if any damage or malfunction occurs during the trial

If the trial product is damaged due to misuse or negligence during the trial period, you may be liable for repair or replacement costs. The Free Home Trial does not constitute a sale, and ownership of the trial product remains with Nourest throughout.

8. Returns and Refunds

Please refer to our Delivery & Returns Policy at www.nourest.com/delivery-and-returns for full details. In summary:

•       Returns must be requested within the applicable return window and the product must be in its original condition

•       Products that have been used, damaged, or returned without original packaging may not be eligible for a full refund

•       Custom or special-order items may be non-returnable

•       Approved refunds will be processed to your original payment method within 7–14 business days

Nourest reserves the right to refuse a return or refund where the product does not meet the return eligibility criteria.

9. Warranty

Nourest products come with a manufacturer's warranty of up to 10 years depending on the product. Full warranty terms, coverage, and claim procedures are available at www.nourest.com/warranty-policy.

The warranty covers defects in materials and workmanship under normal use conditions. It does not cover damage caused by misuse, accidents, unauthorised modifications, or failure to follow the product's care and usage instructions.

10. Intellectual Property

All content on the Nourest Site, including but not limited to text, images, logos, product photographs, videos, graphics, and website design, is the property of Nourest or its content suppliers and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, display, or create derivative works from any content on our Site without our prior written consent. Unauthorised use of our intellectual property may result in legal action.

11. User Accounts

You may create an account on our Site to manage your orders, wishlist, and personal preferences. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorised use of your account. Nourest is not liable for any loss or damage resulting from your failure to protect your account credentials. We reserve the right to suspend or terminate your account if we detect misuse, fraudulent activity, or a breach of these Terms.

•       Submit false, misleading, or fraudulent information or orders

•       Use automated tools, bots, or scrapers to access, collect, or copy data from our Site

•       Infringe upon the intellectual property rights of Nourest or any third party

13. Limitation of Liability

To the fullest extent permitted by UAE law, Nourest shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our Site, products, or services, including but not limited to loss of profits, data, goodwill, or business opportunities.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid for the product or service giving rise to the claim. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

14. Disclaimer of Warranties

Our Site and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We reserve the right to suspend, modify, or discontinue the Site or any feature at any time without notice.

17. Force Majeure

Nourest shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government restrictions, strikes, or disruptions to supply chains or transport networks.

18. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Warranty Policy, and Delivery & Returns Policy, constitute the entire agreement between you and Nourest with respect to your use of our Site and services, and supersede all prior agreements, representations, and understandings.
